Upon the death of a loved one, assets must be preserved for proper distribution. Regardless of whether probate is neccessary, any wills must be filed promptly with the clerk of the circuit court. If probate of a will is neccessary, we represent executors in opening and administering the estate. If there is no will and probate is neccessary, we assist clients in opening an estate and the appointment of an admistrator. We counsel trustees.

A probate estate may be opened in Illinois if, at the time of death, the decedent was domiciled in Illinois or, regardless of where the decedent was domiciled at the time of death, the deceased owned any real estate or personal property in Illinois. Therefore, depending upon the circumstances, you may consider opening an estate in Illinois even if the deceased did not reside in Illinois.
